We not only have experience in litigating direct claims for debts, but also in asserting theories to impose liability against third parties (such as officers, directors, and shareholders) or corporate debtors based on fraudulent conveyance, piercing the corporate veil, and similar approaches. We also have extensive experience with foreclosure on UCC filings for personal property. We have represented lenders seeking to collect amounts due and debtors seeking to avoid unwarranted actions by creditors. Our experience includes pursuit of debtors into bankruptcy and litigation over whether debts are non-dischargeable claims. We represent borrowers looking to adjust and work out debt claims so that the lenders can achieve more than might be available through traditional litigation. We have particular experience in debt collection in the aviation industry, collecting sums due to aircraft lessors in the United States and foreign jurisdictions.
